34. The Book of Sales (bargains)

2/31 Chapter: To pay Zakât [1] is a part of Islâm.
باب: الزَّكَاةُ مِنَ الإِسْلَام
[1] Zakát: A certain fixed proportion of the wealth and of the each and every kind of the property liable to Zakat of a Muslim to be paid yearly for the benefit of the poor in the Muslim community. The payment of Zakát is obligatory as it is one of the five pillars of Islam. Zakát is the major economic means for establishing social justice and leading the Muslim society to prosperity and security. [See Sahih Al-Bukhári, Vol. 2, Book of Zakát (24)].

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ : نَهى رَسُولُ اللَّهِ (ﷺ) أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ، وَلاَ تَنَاجَشُوا وَلَا يَبِيعُ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ، وَلَا يَخْطُبُ عَلَى خِطْبَةِ أَخِيهِ، وَلَا تَسْأَلُ المَرْأَةُ طَلَاقَ أُخْتِهَا لتَكْفَأَ مَا فِي إِنَائِهَا).

Narrated Abu Huraira

Allâh's Messenger (ﷺ) forbade the selling of things by a town dweller on behalf of a desert dweller; and similarly Najsh [1] was forbidden. And one should not urge somebody to return the goods to the seller so as to sell him his own goods; nor should one demand the hand of a girl who has already been engaged to someone else; and a woman should not try to cause some other woman to be divorced in order to take her place. [3:350-O.B]
[1] Najsh means to offer a high price for something without having the intention to buy it but just to cheat somebody else who really wants to buy it. Such a person may agree with the seller to offer high prices before the buyers to cheat them, in which case both this man and the seller are sinful. The seller may falsely tell the buyer that he (i.e. the seller) has previously bought the goods at a certain price which is in reality higher than the actual price.
